It’s been over a decade since the landmark case of Deal v. Hamilton was issued by the Sixth Circuit Court of Appeals forming the line of cases that involve the procedural violation we know as “predetermination.” What was determined as “predetermination” of a District’s FAPE offer then and does it look any different now? This session will review highlights of the development of case law surrounding how districts should respond to parent requests, preferences and concerns when related to an IEP meeting or a FAPE offer. In the face of increasingly more common “predetermination” claims, what can you and your staff say at an IEP meeting? What should you not say? Can you say anything at all before an IEP meeting to discuss or review a district’s offer or provision of placement, program and services? Our session will review the important lessons of ensuring meaningful participation of parents/guardians at, and outside of, IEP meetings. You will receive key guidance on how to maintain procedural compliance while enhancing ways to convey information and responses to parent concerns and requests, and even how to respectfully “agree to disagree.”
